Why are private members clubs exempt from legislation?

Someone mentioned there are 1000's of websites dedicated to this subject. I sadly don't have the time to surf around so I ask here.

I've put it in history since I have a feeling the answer to my question is historical.Why are private members clubs exempt from legislation?It's not really the same these days. A lot of legislation is still relevant to members clubs...especially health and safety rules (such as the smoking ban).



Previously the argument was partly because they are clubs to which you must agree to the rules to become a member, meaning that these are personal agreements, bound by their own contract, so legislation tends to be less useful.



A sceptic would say that the above is all BS, and that it's because so many powerful people are members of this type of club. It's always been one rule for us and one for them. MPs are still allowed to smoke in their bar, which has been open 24hrs a day for years!!
